Warranty & Return Policy

Fitnesse Inc. dba Fitnesse (“Fitnesse”) extends the following Limited Warranty, which applies only to non-commercial, in-home, indoor use (or if you are a non-residential buyer using the device in a commercial setting (e.g., a gym or hotel) (a “Commercial Buyer”), only to indoor use at a single location) of Fitnesse products and apparel. Any other use will void this Limited Warranty. During the applicable Limited Warranty periods described below, the covered components will be free of defects or malfunctions during normal use. Certain exclusions apply, as further described below.

The Limited Warranty applies for the following components of your Fitnesse products and apparel only for the time period indicated. The Limited Warranty applies only against defects discovered within the applicable Limited Warranty period and only so long as your Fitnesse products and apparel remain in the possession of the original purchaser, or, for gifted Fitnesse products and apparel, the owner purchaser of the Fitnesse products and apparel.

LOOP BANDS: 

Fitnesse warrants the loop bands against defects in workmanship and materials for a period of 90 days from the date of original delivery.

RESISTANCE BANDS: 

Fitnesse warrants the resistance bands against defects in workmanship and materials for a period of 90 days from the date of original delivery.

TRAINING MATS:

Fitnesse warrants the training mats against defects in workmanship and materials for a period of 6 months from the date of original delivery.

APPAREL:

Fitnesse warrants all apparel against defects in workmanship and materials for a period of 30 days from the date of original delivery.

EXCLUSIONS AND LIMITATIONS

Who is covered?

  • The original owner of the Fitnesse products and apparel. The Fitnesse products and apparel must remain in the possession of the original purchaser, or for gifted Fitnesse products and apparel, the original purchaser of the Fitnesse products and apparel. This Limited Warranty is not transferable.

What is covered?

  • If a defect arises in the Fitnesse products or apparel or a warranted component within the applicable Limited Warranty period, the purchaser’s sole and exclusive remedy is for Fitnesse to, at Fitnesse’s discretion to the extent permitted by law, either replace or repair the defective or malfunctioning Fitnesse products and apparel or component with the same or a comparable model.

  • Any replacement or repaired component shall be warranted for the remainder of the original Limited Warranty period or 30 days, whichever is longer, or for any additional period that is required by applicable law.


What is NOT covered?

  • Any other Fitnesse products, apparel, or services, non-Fitnesse products or labor, units that are, or that Fitnesse reasonably believes to be, stolen, counterfeit, or purchased from an unauthorized distributor or reseller, units purchased or used outside the U.S., and units missing serial numbers.

  • Damage or equipment failure due to normal wear and tear, improper or negligent assembly, maintenance installation, relocation, or repair (other than that caused by a Fitnesse authorized service or installation technician), use of Fitnesse products with parts or accessories from third parties, or with parts or accessories not originally intended for or compatible with Fitnesse products, or any use contrary to the instructions provided with the equipment.

  • Damage or equipment failure due to accident, abuse, improper or abnormal use, neglect, corrosion, discoloration of products (or any other change in cosmetic appearance that does not affect performance), theft, vandalism, fire, flood, wind, lightning, freezing or other natural disasters or acts of God of any kind, unusual atmospheric conditions, collision, introduction of foreign objects, or modifications that are unauthorized or not recommended by Fitnesse.

  • Incidental or consequential damages. Fitnesse is not responsible or liable for indirect, special, incidental or consequential damages, economic loss, loss of property or profits, loss of enjoyment or use, or other consequential damages of any nature whatsoever in connection with the purchase, use, repair or maintenance of equipment or parts. Fitnesse does not provide monetary or other compensation for any such repairs or replacement parts costs, including but not limited to gym membership fees, work time lost, cost of substitute equipment, maintenance visits or transportation.

  • Equipment used for any use other than indoor at a single family or household (or if you are a Commercial Buyer, any use other than indoor at a single physical location).

  • If you are a Commercial Buyer, equipment used in connection with a violation of the Terms of Service or the commercial program, such as, for example, by not obtaining and paying for a commercial membership.

  • Any attempt to modify the components of Fitnesse products and apparel will void the Limited Warranty.

  • Where permitted by law, replacement units and parts reconditioned to as-new condition by Fitnesse or its vendors may sometimes be supplied as a warranty replacement and constitute fulfillment of warranty terms.


THIS LIMITED WARRANTY IS THE EXCLUSIVE WARRANTY GIVEN BY FITNESSE AND SUPERSEDES ANY PRIOR, CONTRARY OR ADDITIONAL REPRESENTATIONS. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY STATUTORY WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED EXCEPT TO THE EXTENT PROHIBITED BY LAW. IN SUCH EVENT, SUCH WARRANTY IS LIMITED TO THE DURATION OF THE WARRANTY PERIODS SET FORTH ABOVE. THIS EXCLUSION APPLIES EVEN IF THIS LIMITED WARRANTY FAILS OF ITS ESSENTIAL PURPOSES AND REGARDLESS OF WHETHER DAMAGES ARE SOUGHT FOR BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, OR STRICT LIABILITY IN TORT OR UNDER ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE.

Any disputes between you and Fitnesse related to this Limited Warranty or Fitnesse products and apparel will be governed by the then-current dispute resolution procedures in Fitnesse’ Terms of Service, available at Terms.

How do I obtain warranty service?

  • To be eligible for service under this Limited Warranty you must provide Fitnesse with the order number from your purchase and the dated receipt, or other proof of purchase indicating the date purchased, upon discovering any nonconformity or defect. Contact member support if you believe you need service at info@teamfitnesse.com. Claims must be made within the specified warranty period.

This Fitnesse Return Policy (“Return Policy”) is incorporated into the Fitnesse Terms of Service available at Terms. Capitalized terms used but not defined in this Return Policy have the meanings provided in the Terms.

Shipping and Returns

Shipping All products ordered will be delivered to the shipping address you provide. If Fitnesse provides an expected shipping date, such date is an estimate and subject to change. Fitnesse shall not be liable for any change in such expected shipping date. You will be notified via email if there is an issue that will delay your delivery beyond the expected delivery date. Your billing and shipping addresses may be different. We will arrange for packing and shipment of the Fitnesse products and apparel to you; provided that we may charge you if you change your shipping address after ordering Fitnesse products and apparel. Scheduled shipping and delivery dates are estimates only and cannot be guaranteed. We will make commercially reasonable efforts to ship your Fitnesse products and apparel to you by the scheduled delivery dates, but we are not liable, under any circumstances, for any losses, damages or penalties due to any delays in shipments or deliveries.

Returns You may request to return your Fitnesse products and unworn apparel to Fitnesse for a full refund of the amount you paid, minus any shipping or delivery fees, at any time within fourteen (14) days of receiving your Fitnesse products and apparel (or any such longer period as required by applicable law or offered by Fitnesse at the time of sale, the “Return Period”).

This money-back guarantee does not cover dissatisfaction caused by ordinary wear and tear or damage caused by improper use or accidents, subject to the terms of our Limited Warranty. Damage to any Fitnesse products and apparel upon receipt of delivery must be notated upon delivery. Please thoroughly inspect your Fitnesse products and apparel and report any damage within 48 hours to the delivery company and Fitnesse support at info@teamfitnesse.com.

Cancellations You may request to cancel your order for a full refund at any time before your items are shipped.

Per the terms of the Limited Warranty, if a defect arises in your Fitnesse products or apparel or a warranted component within the applicable Limited Warranty period, your sole and exclusive remedy is for Fitnesse to, at Fitnesse’ discretion to the extent permitted by law, either replace or repair the defective or malfunctioning Fitnesse product or apparel or component with the same or a comparable model or, if agreed by the parties, Fitnesse may provide a credit in such amount toward your purchase of a new Fitnesse products and apparel. Any replacement or repaired component shall be warranted for the remainder of the original Limited Warranty period or 14 days, whichever is longer, or for any additional period that is required by applicable law.

Returning Your Products Fitnesse will offer at no charge packaging and shipping for your return in the event you return your Fitnesse products/apparel due to a defect; for all other returns, you are responsible for paying all associated packing and shipping costs.

Your Fitnesse products and/or apparel are expected to be returned in the same condition that it was received. If there are missing accessories or damage to the equipment that was not noted upon receipt, a fee will be associated for refurbishment and repair that will be deducted from your purchase price prior to refund.

To request a return or report a defect, please email our customer service department at info@teamfitnesse.com and provide your name, contact information and the serial number on your Fitnesse product. Nothing in this Return Policy will reduce or otherwise affect your statutory rights in relation to your Fitnesse products.
